Client gifting in life sciences is a minefield most gift guides ignore. Before you order anything with a logo on it, you need to know who is actually allowed to receive it — because in this industry, the answer is narrower than anywhere else.

The rule most gifting guides skip

Under both the PhRMA Code and the AdvaMed Code of Ethics, companies may not give non-educational branded items — pens, mugs, drinkware, notepads — to healthcare professionals, even when the item is inexpensive. The branded-swag ban has been in place since 2009, and the only carve-out is occasional educational items ($100 or less) with no value to the HCP outside their professional responsibilities. Federal transparency rules add teeth: transfers of value to covered recipients are tracked and reportable above annually adjusted thresholds.

So if your client list includes prescribers, clinicians, or hospital decision-makers: branded gifts are off the table. Your compliance team has final say — this article is not legal advice — but the safe assumption is simple. Don't gift HCPs.
